HOME MINISTRY TO RETAIN FINAL SAY ON AFSPA IN JAMMU AND KASHMIR, LADAKH.
Context: The cabinet secretariat notified rules reasserting that the union home ministry would be the authority to decide on the imposition of the AFSPA in the union territories of Jammu, Kashmir and Ladakh .
Earlier, before the state of Jammu and Kashmir was bifurcated and downgraded, it was the home ministry or the governor that was the designated authority for notifying AFSPA.
The act has been in force in these areas since 1990.
ARMED FORCES( SPECIAL POWERS) ACT (AFSPA):
- AFSPA 1958 is an act of the parliament of India that grants special powers to the Indian armed forces, the power to maintain public order in ‘disturbed areas’.
- The act empowers security forces to conduct operations anywhere and arrest anyone without a warrant.
- The act has received severe criticism from several sections for alleged concerns about the human rights violations in the regions of its enforcement alleged to have happened.
